These Terms of Use (“Terms”) govern your use of The Homies mobile application, its website pages, and related services (the “Service”). The Service is operated by Motivated Moms LLC (“Motivated Moms,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who may use The Homies
Only an adult with legal capacity may create or own an independent The Homies account. An authorized adult household organizer may create and supervise a managed profile for a child. A managed child profile and any adult-created username or credential remain controlled by the adult account holder and do not automatically convert into an independent account. The person creating or managing a child profile represents that they have authority to do so.
The Homies is designed for families and household organization. It is not offered as a school, classroom, daycare, camp, employer, healthcare, emergency, or government service.
Your account
You are responsible for providing accurate information, protecting your devices and sign-in credentials, and promptly notifying us if you believe your account has been compromised. Do not share passwords or one-time verification codes. You are responsible for activity carried out through your account unless caused by our failure to use reasonable security measures.
A Crew owner or authorized organizer may invite members, create managed profiles, assign roles, and manage shared household information. Those controls do not authorize an organizer to impersonate another person, access another member’s private data outside the product controls, or act without required parental or household authority.
Household content and permissions
You retain ownership of names, task lists, notes, schedules, icons, goals, rewards, and other content you provide. You give Motivated Moms LLC a limited, worldwide, non-exclusive license to host, copy, process, transmit, display, and modify that content only as needed to operate, secure, support, and improve the Service and comply with law.
You represent that you have the rights and permissions needed to add content and information about other household members. Avoid entering sensitive medical, financial, government-identification, or similar information in task names, notes, rewards, Crew names, or profile fields.
Friends League
Friends League is for eligible adult account holders. When enabled, a member may choose a public display name and avatar, connect with friends, and share aggregate completion scores. Private task names, notes, email addresses, Crew rosters, and completion times are not intended to be shared through Friends League. Do not use Friends League to harass, threaten, deceive, exploit, or expose another person’s private information. You may remove or block connections.
Screen Time features
The Homies may help a household organizer configure rules involving Apple Screen Time or similar platform controls. Availability and behavior depend on the device, operating system, permissions, family settings, and platform provider. These features are organizational tools, not security, emergency, parental-supervision, medical, or safety guarantees. Keep platform software current and maintain appropriate real-world supervision.
Subscriptions, billing, and trials
Some features require a paid subscription or trial. Prices, billing periods, trial terms, renewal information, and included features are shown before purchase. Purchases may be processed by Apple, Google, RevenueCat, Stripe, or another payment provider. Their terms and refund rules also apply.
Unless the purchase screen says otherwise, subscriptions renew automatically until canceled through the provider that bills you. Deleting The Homies account or app does not cancel an external subscription. Cancel renewal in the applicable App Store, Google Play, or customer portal. Access may continue through the end of the paid period, subject to the billing provider’s rules. Refund eligibility is determined by the provider that processed the purchase and applicable law.
We may change subscription offerings or prices prospectively, with notice where required. We may verify purchases, restore entitlements, correct billing errors, and prevent fraud or duplicate access.
Acceptable use
You may not:
- Use the Service for unlawful, fraudulent, abusive, deceptive, or harmful activity.
- Harass others, expose private information, or create profiles without appropriate authority.
- Attempt to gain unauthorized access to accounts, systems, source code, or non-public data.
- Interfere with, overload, probe, scrape, reverse engineer, or bypass security or usage limits, except where applicable law expressly allows it.
- Upload malware or use automated systems in a way that disrupts the Service or other users.
- Use The Homies to operate a classroom, school, daycare, camp, employer, or similar institution unless we expressly approve that use in writing.
- Resell, sublicense, or commercially exploit the Service except under a separate written agreement.
Our intellectual property
The Homies software, designs, logos, text, task-library content, and other materials supplied by us are owned by Motivated Moms LLC or its licensors and are protected by intellectual-property laws. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. No other rights are granted.
Third-party services
The Service relies on app stores, identity providers, cloud hosting, notification services, subscription providers, and operating-system features. We are not responsible for third-party services that we do not control. Their availability, terms, and privacy practices may affect your use of The Homies.
Account suspension and termination
You may stop using the Service at any time and may request deletion through the in-app flow or The Homies Account Deletion. We may suspend or terminate access when reasonably necessary to protect users or the Service, respond to unlawful conduct, address material violations of these Terms, prevent fraud or security harm, or comply with law. Where appropriate, we will provide notice and an opportunity to address the issue.
Service changes and availability
We may add, change, or discontinue features. We work to keep The Homies available and reliable, but we do not promise uninterrupted, error-free, or permanently available service. Maintenance, security incidents, platform changes, and circumstances outside our control may affect availability.
Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits consumer rights or warranties that cannot lawfully be excluded.
Limitation of liability
To the extent permitted by law, Motivated Moms LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunities arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid us for the Service during the 12 months before the claim or US $100. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
Changes to these Terms
We may update these Terms as the Service or law changes. If a change is material, we will provide reasonable notice by updating this page, changing the “Last updated” date, or providing an in-app or email notice where appropriate. Continuing to use the Service after the effective date means you accept the updated Terms.
